Jim McGraw Wins Appeal Affirming Dismissal of Real Property Claim for Waste Management of Texas, Inc.
The First Court of Appeals affirmed a summary judgment obtained by Gray Reed & McGraw litigation partner Jim McGraw for Waste Management of Texas, Inc. Mr. McGraw also handled the case at the trial level to quickly dispose of a claim that challenged Waste Management's right to a small strip of land through Waste Management's Sam Houston Recycling Center. The plaintiff sued Waste Management claiming he owned the property because he purchased an old abandoned railroad right of way. Mr. McGraw convinced both the trial court and the court of appeals that the applicable deeds gave Waste Management the land in dispute and that it was only burdened by a possible railroad right of way long-since abandoned summarily dismissing all of the plaintiff's claims.
Jim McGraw has represented both plaintiffs and defendants in the trial and appeal of complex civil business cases in state and federal courts. He has successfully prosecuted and defended anti-trust actions and breach of contract claims as well as business tort, personal injury and insurance cases. He has led the defense of several clients in actions caused by oil spills and pipeline ruptures.
