Our experience in cryptocurrency matters is extensive. Most of our practice members have been at the forefront of these unique issues since the early days of digital assets and blockchain technology, and we have a proven track record of resolving difficult matters as regulatory enforcement becomes more complex and government enforcement becomes more aggressive. Several practice members also have significant backgrounds as former litigators for the Department of Justice and the Securities and Exchange Commission with first-hand knowledge of how regulators build and prosecute cases involving cryptocurrency assets, taxation, securities, fraud and related issues.

Our broad experience includes strategy design and execution in all types of crypto-related compliance matters, representation before regulatory agencies, disclosure issues with John Doe and other government summonses and information requests, preparing IRS voluntary disclosures for unreported or improperly reported cryptocurrency transactions, helping clients fulfill registration and disclosure requirements related to crypto-based offerings, and much more.

Tax and Transactional Matters

We have considerable experience handling tax and transactional matters in the cryptocurrency and other digital asset space, including tax planning, tax-efficient entity structuring, tax treatment of crypto-based strategic and financing transactions, review of private placement memoranda, and other matters. We regularly advise cryptocurrency investors, bitcoin miners and various companies providing products or services involving blockchain technology, digital currency and non-fungible tokens (NFTs). We also counsel international clients on tax residency rules and treaties, foreign bank account issues and related tax matters.
