Three Leading Firms in $750 Million Rice Settlement File Class Action Suits against Syngenta on Behalf of Corn Farmers in Twenty States
Firms Contend Syngenta Should be Held Accountable for Farmers’ Economic Damages
December 18, 2014 - Three law firms that played a major role in a significant settlement on behalf of U.S. rice farmers who suffered financially due to genetically modified rice seed have filed two class-action lawsuits on behalf of U.S. corn farmers now suffering similar economic losses from genetically modified corn.  The firms filed their complaints on November 11 in federal court in St. Louis and Kansas City, Kan., and amended them today to include 20 states, making it the most comprehensive action taken on this issue to date.  These 20 states represent 86 percent of the corn planted in the United States in 2014.

Gray Reed & McGraw Secures Major Victory for Oil and Gas Operator
December 10, 2014 - Gray Reed & McGraw attorneys Julia Palmer, Andy Landry, and Preston Kamin won a two-week jury trial in the 270 th District Court resulting in a $12.741 million verdict in their client’s favor. The client, a major oil and gas operator, was fracing a gas well in the Haynesville shale formation when wellhead equipment rented from the defendant catastrophically failed.  Afterward, as a result of a sudden uncontrolled high pressure release, the well was lost, forcing the operator to re-drill the well. The jury found the defendant to be 100% at fault and the rented equipment to be a  defective product.  The jury further found no fault on behalf of  Gray Reed’s client, the operator.

September 17, 2014 - On September 15, 2014, the New Mexico Supreme Court issued an opinion in an eight year-old class action case, holding that oil and gas operators must pay interest on production proceeds held in suspense, regardless of whether the interest owners signed division orders purporting to waive the right to receive statutory interest on suspense funds.   The opinion represents a long-awaited victory for the class of New Mexico mineral interest owners, including The First Baptist Church of Roswell, The Historical Society of Southeast New Mexico, Inc., and The Roswell Woman’s Club, Inc.  The class is represented by lead counsel Jim Ormiston of Gray Reed & McGraw, PC and Kelly Mack Cassels of Sanders, Bruin, Coll & Worley, P.A.

July 7, 2014 - In Texas civil district courts, of the cases disposed of in 2013 (excluding family cases), 0.50 percent were tried to a jury.  With institutions seeking a “roadmap for reform” in our 21st century civil justice system, issues of costs and length of time for resolution of matters and satisfaction with the overall process are at the forefront of the debate.  With the decline of jury trials, excellence in litigating matters is paramount. To assist in navigating the litigation process, Gray Reed & McGraw is pleased to announce the release of ALM’s book Texas Business Litigation in which legendary trial lawyers and specialists analyze a range of issues encountered in the litigation process. April 24, 2014 - Thirty riders from the Gray Reed Team strapped on their bicycle helmets and made the 150-mile trek from Houston to Austin to raise awareness and financial support for Multiple Sclerosis in the 2014 MS 150. Eight Gray Reed employees and 22 friends of Gray Reed raised more than $26,000 toward a cure for a condition that affects more than 2.3 million people worldwide. The 2014 event raised more than $16.5 million.

Court Upholds Judgment in Favor of Former Police Officer
November 1, 2013 - The 14th Court of Appeals in Houston issued its opinion affirming judgment in favor of Gray Reed & McGraw client Troy Perry. Mr. Perry filed suit in 2006 against Alief Independent School District and two of its police officers for violating his rights under the Texas Whistleblower Act and the First and Fourteenth Amendments to the United States Constitution.

Three Gray Reed Attorneys Named to Leadership of State Bar of Texas Tax Committee
August 7, 2013 - Gray Reed & McGraw is proud to announce the selection of three attorneys to leadership in the State Bar of Texas Tax Section Council. Houston Member Deidra Wilson Hubenak will serve as chair of the International Tax Committee. Houston Associate Austin Carlson will serve as vice chair of the International Tax Committee. Dallas Associate David Gair will serve as vice chair of the Tax Controversy Committee.The appointments will last for the 2013-2014 fiscal year. The International Tax Committee promotes sharing knowledge among members of the International Tax community. They also sponsor an annual one-day seminar in the late fall on International Tax. The Tax Controversy Committee focuses on all aspects of tax controversy and tax litigation, including civil and criminal, federal and state. The Committee sponsors a seminar each year on current topics of interest to tax controversy practitioners.

USDA Confirms Presence of Genetically Modified Wheat, Trade Impact Possible
May 30, 2013 - The United States Department of Agriculture announced on May 29, 2013, that it confirmed the presence of a genetically modified wheat variety on an Oregon farm.  Reports state that the wheat was developed by Monsanto and field tested in Arizona, California, Colorado, Florida, Hawaii, Idaho, Illinois, Kansas, Minnesota, Montana, Nebraska, North Dakota, Oregon, South Dakota, Washington and Wyoming between 1998 and 2005.   According to the USDA’s press release, “There are no genetically engineered wheat varieties approved for sale or in commercial production in the United States or elsewhere at this time.”

Ormiston Obtains a Take Nothing Defense Verdict in Favor of Plains Exploration and Production Company
June 25, 2012 - On June 20, 2012, Ji m Ormiston , a Shareholder of Gray Reed & McGraw and head of the Litigation Section, obtained a take nothing defense verdict in favor of Plains Exploration and Production Company (PXP) in the 95th District Court of Dallas County, Texas.  PXP, as operator of a large oil and gas lease in Zapata County, Texas, was sued by two non-operators who alleged they had been overcharged for indirect operating expenses under a 1960 Joint Operating Agreement. The jury found that PXP had properly charged the Plaintiffs for district and camp expense and administrative overhead under the terms of the contract. Based on the jury's verdict, PXP has filed a motion for entry of a final judgment in its favor.
