Avoiding the Pitfalls of the Foreign Corrupt Practices Act

The Department of Justice and Securities and Exchange Commission have dramatically increased their efforts to prosecute companies under the Foreign Corrupt Practices Act. If your company operates outside of the United States, and individuals associated with your company have interaction with government officials, it is imperative that you understand the FCPA as violations of the FCPA can have both criminal and civil consequences. Although many companies believe that their employees would never pay bribes, agents and representatives that are affiliated with your company can pay bribes, which will affect both you and your company. Recent prosecutions have also shown that no industry is immune from prosecution; even companies in traditionally "low-risk" industries are being prosecuted.
