Jonathan Hyman and Jim Ormiston successfully prosecuted an arbitration on behalf of Choice Energy in a proceeding against a former executive. In November 2008, Choice terminated the executive's employment agreement "for cause" and initiated an arbitration proceeding seeking a declaratory judgment that it properly terminated the contract. Thereafter, the executive asserted counterclaims alleging his contract was improperly terminated, and sought more than $2 million in compensation. Following a week long arbitration hearing, Judge Ruby Sondock determined Choice had properly terminated the contract "for cause," and awarded the executive less than $200,000 in damages, roughly the amount of compensation owed as of the termination.
