Gray Reed & McGraw represented the founder of Common Grounds, a popular coffee shop near Baylor University, in a trademark lawsuit against the shop’s operator.
The plaintiff, Gray Reed’s client and the holder of rights to Common Ground’s name and markings, sued the operator on March 16, 2018, for moving forward with a plan to open another Common Grounds location in the Waco area without a license agreement. The plaintiff sought a temporary injunction to stop the defendant from opening the second location and using the company logo, trade secrets, and recipes without authorization.
On March 17, 2018, after the defendants removed all signage and agreed to cease all other unauthorized uses of the client’s intellectual property, Gray Reed dismissed the lawsuit, and quickly negotiated and closed a business-oriented resolution of the parties’ dispute. The dispute’s resolution bolsters the client’s long-planned business ventures involving future restaurant and coffee shop operations.
